Who we are

This store is operated by Futura Trailers Inc., a Delaware corporation ("we", "us", "our"), trading from 15342 Texaco Avenue, Paramount, CA 90723, United States. By placing an order you accept these terms. If you order from a dealer account, our dealer trade terms also apply and take priority where they differ.

Parts and fitment

We list parts for Futura and SHIFTR trailers and, where we can, we match them to your trailer from its VIN or from the model and year you select.

That match is a guide based on our production records. Build specifications change over time, trailers get modified, and records can be incomplete. The final responsibility for confirming that a part suits your trailer rests with you or your fitter. If you are not sure, contact us before you order.

Colours on screen are approximate. We may correct a listing, a price or a specification at any time, and we may limit or refuse an order.

Prices and payment

Prices are in US dollars and exclude shipping and sales tax unless stated. Payment is taken when you place your order.

Acceptance of orders

Your order is an offer to buy from us. We accept it, and a contract is formed, only when we dispatch the goods. An order confirmation or emailed receipt acknowledges that we have received your order; it is not acceptance of it. Where we do not accept all or part of an order we will tell you and refund anything already taken for the part we have not accepted.

Pricing and product information errors

We take reasonable care to keep prices, specifications and availability correct. The catalogue draws on data from our production and inventory systems, so errors do occasionally happen.

If we find an error in the price of goods you have ordered before we have dispatched them, we will contact you and give you the choice of confirming the order at the correct price or cancelling it. If we cannot reach you within a reasonable time we will treat the order as cancelled and refund you in full.

Where a price is obviously incorrect and a reasonable person would have recognised it as a mistake, including any price shown as zero, we are not obliged to supply the goods at that price. We may cancel the order and refund you in full. Nothing in this section lets us charge you more than the price shown when you ordered without your agreement, and nothing in it limits any right you have under applicable state or federal consumer law.

Fitting and use

Trailer parts affect the roadworthiness of a vehicle. Parts should be fitted by a competent person and to the manufacturer's instructions. Any part affecting brakes, lighting, axles, the coupling or the lifting system should be fitted by a qualified technician.

We are not responsible for loss caused by incorrect fitting, by use of a part on a trailer it was not supplied for, or by continued use of a part that is worn or damaged.

Warranty and returns

Our refund and returns policy and our parts warranty statement form part of these terms.

Limitation of liability

To the fullest extent permitted by law, our total liability to you in connection with any part, order or these terms is limited to the amount you paid for the part concerned.

We are not liable for loss of profit, loss of use, loss of a booking or event, towing, storage, recovery, vehicle hire, or any other indirect or consequential loss.

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded or limited. Some states do not allow the exclusion or limitation of incidental or consequential damages, so parts of this section may not apply to you.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. This does not take away any protection you have under the consumer protection laws of the state where you live. You may bring a claim in the small claims court where you live or in any other court that has jurisdiction.

Accounts

You are responsible for keeping your account details secure and for what happens under your account.

Changes

We may update these terms. The version that applies to your order is the one published when you placed it.
